General terms and Conditions of Sale

The General Terms and Conditions of Sale detailed below are intended to define the conditions in which the products are commercialized by Godefroy SAS on behalf of Bombón de algodón.

They explain the rights and obligations of both companies Godefroy SAS and Bombón de algodón (hereinafter “Us”) and their customers (hereinafter “Customer”) concerning the sale of women’s clothing products.

For every service provided by the company Godefroy SAS and Bombón de algodón, the Customer is unreservedly agreeing to the current general terms and conditions of Sale.

Godefroy SAS and Bombón de algodón reserve the right to adapt or modify at any time the current General Terms and Conditions of Sale.

Every Customer of legal age can create a client account free of charge by going on the heading “My account” in the upper right side of the page. The Customer is required to fill in a form with their personal data.

The Customer agrees to provide complete, accurate, and up-to-date information, and not to usurp the identity of a third party nor to conceal or modify his or her age. The Customer must choose a username and password. If the chosen username is already in use, the system will ask to provide a new one.The usernames and passwords are personal and confidential. In the case of suspected fraudulent use by a third party, the Customer should contact Us as soon as possible by e-mail or by telephone.
The customer account is strictly personal and allows the Customer to identify himself or herself before confirming any order. Only one account per Customer will be authorized.

The Client can delete his or her account at any moment by addressing Us an e-mail with said request to the e-mail info@bombondealgodon.com.

When ordering online, the Customer agrees not to use the clothes for commercial purposes or resale.

The Customer can select as many products as he or she wishes, these will be added to the “Cart” and will be visible at the top right of the page.

The Customer will proceed to the purchase by clicking on “Order”.

The summary of the order can be found in the Cart. This field shows the list of selected products that the Customer can modify or remove, as well as their price and delivery fee, and allows the use of a promotion code.

Once the “Cart” is validated by clicking on “Proceed with the order”, the Customer will be brought to indicate a shipping address, a billing address if different, as well as the payment method. At that stage, the Customer will also be asked to tick a box accepting the general terms of sale.

After validation of the payment, once the order has been placed and validated, an e-mail confirming the order will be sent automatically to the Customer.

If the e-mail confirming the order is not received, the Customer is asked to contact us via e-mail or telephone. We advise the client to print or save the e-mail confirming the order.
Once the customer has received the order confirmation email, the order cannot be modified.

Every order is submitted to our prior validation and is only officially confirmed once the Customer receives an e-mail confirming the expedition of the article(s) followed by the bill and the tracking number of the parcel.
The Customer will find the bill in their customer area in the “Orders” section by clicking on “My account” at the top of the page.

We reserve ourselves the right to block a Customer’s order until its resolution for the following reasons: unavailability of servers, a default of payment, the transaction represents a risk, a wrong address or any other problem regarding the Customer’s account, an order made by a minor, unavailability of the product, an input error that causes the product to be listed at the wrong price, a mistake in the promotional offer, We suspect the purchase for commercial purposes and resale.

In case of an order cancellation, an e-mail will be sent to the Customer.

The prices indicated on the site are calculated including the 20 % VAT rate in force in France. These prices do not include the cost of delivery. Shipping costs may be added when placing an order.
Regarding sales outside the European Union, customs clearance, payment of duties or taxes, are the responsibilities of the Customer.

However, we agree to invoice the products ordered at the prices indicated at the time of the registration of the order.
The prices applied are confirmed to the Customer when validating the order.

Promotional offers can appear on the website. They are only valid for a limited time and may only concern certain products. We reserve the right to end any offer without prior notice.
The promotional offers on this website are exclusively reserved for orders online and are not applicable in stores.
If the Customer purchases a product in-store that is the subject of an exclusive promotional offer online, he/she cannot ask to be refunded the difference in price.

The reduction applied to the selling price can be presented in two ways, either by a direct percentage remittance on the selling price or the use of a promotion code.
The percentage remittance on the selling price and the discounted sale price are displayed on the product(s) concerned. Remittances cannot be used in combination with any other type of sale promotion.
Every promotion code, in order to be valid, must be entered during the process of placing the order.

If the Customer uses a payment method such as an international credit or debit card, he/she may be charged additional bank charges by the bank or banking provider who will determine the applicable exchange rate.

Tax refund is neither available online at www.bombondealgodon.com nor is it available in stores.
Since the storekeeper is free to apply the tax refund, the buyer cannot demand it from the seller.

Payment is made in its entirety once the Customer places the order.

Paypal and Stripe are the online payment methods available on this website. The transactions made on this website are secured by these technical service providers.
The Customer can pay by credit or debit card even without owning a Paypal account.

Payment is made online by the following payment methods: Visa, Mastercard, American express.

Delivery fees by geographical area

Delivery fees indicated on the order recap will be charged to the Customer in addition to the selling price of the products.
These fees vary according to the Customer’s geographical area.

For orders outside of France, import taxes or custom duties that apply to the country of destination are the responsibility of the Customer.

Free delivery

Delivery is free for all orders from 100 € of purchase in Metropolitan France.

Delivery is free for all orders from 150 € of purchase in Europe.

Delivery to the store is free.

Order processing

Every order will be treated within 3 to 5 working days.

Every order made on a Saturday or a Sunday will be treated the following Monday.

Every order made after 8 pm or on a public holiday will be treated on the next working day.

Type and time of delivery

France

Deliveries are provided through the services of Colissimo from La Poste France in Metropolitan
France, Corsica and Monaco.

The package will be delivered to the Customer in the mailbox or hand-delivered against a valid counter-signature.

The indicative delivery time is 48h (working days) and is subject to deposit limit times.

International

For orders outside of France, deliveries are provided by Colissimo international from La Poste France.

The package will be hand-delivered to the Customer against a valid counter-signature.

The indicative delivery time is 3 to 8 working days depending on the geographical area.

Delivery tracking and billing

As soon as the order is handed over to the carrier an e-mail confirming the shipment will be sent to the Customer with the invoice corresponding to the purchase and the tracking number of the parcel.

The Customer will find the bill in their customer area in the “Orders” section by clicking on “My account” at the top of the page.

Change of adress

The Customer can register a delivery address and a billing address on his or her account.

These can be modified by the Customer when placing the order or at any time by entering their customer area, in the “Addresses” section by going to “My account” at the top of the page.

However, once the order has been paid, the Customer can no longer modify the delivery address on that order.

Absence at the time of delivery

France

In case of absence or if the size of the package does not allow a mailbox delivery the package is at your disposal at the post office to which the Customer is attached to. A notice is left in the Customer’s mailbox and the package can be retrieved upon presentation of an ID.

Upon the arrival of your package at the post office the Customer has 10 working days to retrieve it. If the package is not retrieved within this period, it will be returned to Us.

If the Customer has not retrieved his or her order within 6 days at the post office, he or she will be notified by e-mail.

International

In case of absence or if the size of the package does not allow a mailbox delivery the package is at your disposal at the post office to which the Customer is attached to. A notice is left in the Customer’s mailbox and the package can be retrieved upon presentation of an ID.

Upon the arrival of your package at the post office the Customer has 15 days to retrieve it from the following day of the notice of passage. If the package is not retrieved within this period, it will be returned to us.

Late delivery

If a problem on our part occurs between the moment of receipt of the e-mail confirming the order and the receipt of the e-mail confirming the shipment therefore causing a delay in delivery, we will contact the Customer via e-mail to report on the situation.
Either a delivery extension is proposed by Us and accepted by the Customer or the Customer can cancel his or her order.

If the delay in delivery is caused by the carrier, we cannot be held responsible.

Returned package

In case the package is returned to us because the Customer has failed to retrieve the package within 15 days following the deposit of the notice of passage or because the delivery addressed previously registered by the Customer is erroneous,
the order is canceled and the Customer refunded. The shipping costs are not refunded.
An e-mail is sent to the Customer to inform him.

Free Returns

Returns are offered in metropolitan France up to the cost of delivery.

Returns are free in-store.

Return and exchange conditions

The clothes must be returned in perfect resale condition, in their original packaging, and with their labels. They must therefore not have been worn, washed, perfumed, ironed or damaged.

Time limit for a return

Any Customer has the right of withdrawal without penalty upon reception of their order. The Customer must imperatively notify us by e-mail and return the package to us within 15 days from the day of receipt of the order. If this period expires on a Saturday, Sunday or a public holiday or non-working day, it shall be extended to the first following working day.

After this period, no claim will be accepted, the products being then deemed compliant, and the sale final.

Return and refund procedure

Return and refund procedure :

  1. Make the request to the email address info@bombondealgodon.com indicating the reason for the return. Don’t forget to include the invoice for the purchase as an attachment.
    The Customer can find the invoice in the e-mail confirming the shipment of the item(s).
    The Customer can also find the invoice in their customer area in the “Orders” section by going to “My Account” at the top of the page..
  2. The Customer will receive an e-mail from us confirming the return request.
  3. Prepare your package in compliance with the return and exchange conditions.
  4. Send the package to the following address :

  5. Once We have received the package, the Customer receives an e-mail confirming the cancellation of the order.

Repayment period

Once the package is received, the refund request is processed within 48 hours following the cancellation confirmed by e-mail.

The Customer’s bank account will be re-credited within 5 to 10 days if they have used the Stripe payment platform.

If the Customer used their Paypal account to make the payment, a refund on a credit card may take up to 30 business days, depending on the card issuer.

Amount refunded

In the case of a return to metropolitan France, the Customer shall be reimbursed for the totality of the order including the price of the product(s), the delivery costs, and the return costs up to the cost of delivery.

In the case of a return outside metropolitan France, the return costs are not refunded to the Customer, nor are the taxes and customs duties paid upon delivery. Only the price of the product(s) and the delivery costs will be refunded.

In the case of a return in metropolitan France and outside France, if the order contains several items and the Customer wishes to return only part of them, the delivery costs are not refunded to the Customer, whatever the geographical area. Only the price of the product(s) and the return costs up to the cost of delivery in metropolitan France are refunded to the Customer.

In the case of a cancellation due to a delay in delivery on our part, the Customer will be refunded: the price of the product or products, and delivery costs.

In the case of a refund request for a package returned to us by the post office, the shipping costs are not refunded to the Customer. Only the price of the product(s) will be refunded.

In the case of a return due to damage during transport, the Customer shall be reimbursed: the price of the product(s), the delivery costs, and the return costs up to the cost of delivery in metropolitan France.  

In the case of loss during transport, the Customer is reimbursed the price of the product(s) and the delivery costs.

In the case of a return concerning a purchase during an exclusive private sale of the online sales site, or a purchase of a product sold off, the Customer is refunded: the price of the product or products and delivery costs. The costs of return are at the expense of the Customer.

Damage or loss during transport

In case of damage during transport or loss by the carrier, the refund procedure is respected, considering that the customer is exempt from any responsibility.

Exchange

For the moment we are not in a position to offer the Customer to exchange a product or products via the post office.

If the Customer wishes to exchange one or more products, they must follow the procedure for return and refund of the product(s) purchased, and recommend the desired product(s).
It must subsequently take into account the availability of the product.

Fast in-store delivery

The Customer assumes entirely and exclusively the risks relating to the articles from the moment they are collected in the store.

The processing of the order and the delivery in-store is done within 24 to 72 hours after receiving the order confirmation by e-mail.

As soon as the order is ready to be picked up, an e-mail confirming the availability of the order in the store will be sent to the Customer with the invoice corresponding to the purchase.

To withdraw their order, the Customer must present himself during the opening hours of the store by providing an identity document as well as the email of the availability of their order in the store.
The in-store availability email can be presented on paper or electronic media (tablet, smartphone, or other).

Quick return to store

The Customer may return the package within 15 days from the day of receipt of the order, respecting the conditions of return and exchange.

Return and refund procedure in store :

No complaints are accepted at the store.

Private sales and sales are exclusive to the online sales site.

In the event of force majeure, beyond our control, such as strikes, riots, wars, bad weather, natural disasters, epidemics, transport blockages, government or legal restrictions, Internet or telecommunications network breakdowns, regulatory changes in forms of marketing, fire, aggravated theft, shortages of supplies or equipment, intentional deterioration of equipment or data, a case of force majeure at our suppliers, situations where We cannot commit ourselves to respect the general terms and conditions of sale, in particular during a delivery or a return and refund procedure, We are obliged to contact the Customer by e-mail to inform him of the situation within an estimated period of 3 to 5 days.

The obligations of both parties shall remain suspended for the duration of the force majeure event without compensation. The waiting time may vary depending on the severity of the situation. Beyond 3 months, the transaction can be cancelled at our request or at the request of the Customer without compensation on both sides.

The General Conditions of Sale comply with French law.

For any dispute, the Customer is invited to contact Godefroy SAS and Bombón de algodón for a resolution first of all, by e-mail or telephone. In the absence of agreement, any dispute will be subject to the jurisdiction of the French courts.
